eGift Terms

These eGift Terms apply to merchants who enable eGift Certificate sales and delivery through NetGCS. They are meant to set clear expectations and help keep your eGift program safe, reliable, and customer-friendly.

Plain-English summary: NetGCS helps you sell and deliver eGift Certificates. You are responsible for honoring your eGifts, setting your redemption rules, and following applicable laws. We help with tooling, delivery, and fraud controls.

1) Definitions

  • eGift Certificate: A digital gift certificate purchased online and delivered electronically to a recipient.
  • Merchant: The business enabling eGift sales through NetGCS.
  • Customer: The purchaser and/or recipient of an eGift Certificate.

2) Your responsibilities as a merchant

  • You are responsible for honoring valid eGift Certificates issued for your business.
  • You are responsible for your store policies (redemption rules, exclusions, and any restrictions).
  • You agree to comply with applicable local/state/federal laws regarding gift certificates.
  • You are responsible for maintaining accurate business contact information in your merchant profile.

3) eGift sales, delivery, and notifications

  • NetGCS attempts to deliver eGifts and receipts via email using the information provided at checkout.
  • Delivery can be affected by spam filtering, typos, mail provider issues, or temporary outages.
  • Merchants should provide a support contact (email/phone) for customers needing help with delivery or redemption.

4) Refunds, chargebacks, and disputes

Merchants control their refund policy for eGift purchases, unless restricted by law. In general:

  • You may be responsible for chargebacks, payment disputes, and fees imposed by payment processors.
  • If fraud is suspected, NetGCS may temporarily hold fulfillment while reviewing the transaction.
  • NetGCS may assist with transaction records to help you resolve disputes.

5) Fraud prevention and abuse

  • NetGCS may apply fraud controls (rate limits, device/IP signals, velocity checks, etc.).
  • We may block or delay fulfillment of suspicious transactions to protect merchants and customers.
  • Merchants agree not to use eGift features for prohibited or illegal activity.

6) Redemption rules and expiration

  • Gift certificate laws vary by location. Some jurisdictions limit expiration dates and fees.
  • You are responsible for configuring your redemption rules to match your policies and applicable laws.
  • NetGCS does not provide legal advice; consult an attorney if you have questions about compliance.

7) Service availability

  • NetGCS aims for high availability, but like any online service, interruptions can occur.
  • We may perform maintenance that temporarily affects access to dashboards, delivery, or reporting.

8) Limitation of liability

To the maximum extent allowed by law, NetGCS is not liable for indirect, incidental, special, consequential, or punitive damages related to eGift use, delivery, redemption, disputes, chargebacks, or lost profits. Our total liability for any claim related to eGift services is limited to the amount you paid NetGCS for the eGift service in the prior three months (if any).

9) Changes to these terms

We may update these eGift Terms from time to time. If changes are material, we will make reasonable efforts to notify merchants through email or dashboard notices.
